Terms of Service
Business Analystic Terms of Service (Effective 2020, Revised Quarterly). By accessing or using our platform, you agree to the following terms, which govern your use of data, reports, and predictive models. These terms are designed for operations managers and business analysts (target demographic 27–42) who construct data-backed reports. All disputes are governed by United States law.
- Grant of License. Business Analystic grants you a non-exclusive, non-transferable, limited license to access and use the platform for internal business analysis. This license does not permit redistribution of proprietary metrics, including the three leading indicators that predict next quarter’s revenue dip (the “Core Trio”). Unauthorized sharing of the Core Trio methodology or coefficient weights constitutes a material breach.
- Intellectual Property Ownership. All content, including but not limited to dashboards, statistical models, regression outputs, and the unique algorithm that identifies which three metrics (e.g., customer churn velocity, average deal slippage, and support ticket escalation rate) predict revenue contraction, remains the sole property of Business Analystic. Users retain ownership of input data they upload, but grant us a royalty-free license to process that data for the purpose of generating reports and improving the platform’s predictive accuracy (p < 0.05).
- Copyright Protection. No part of the platform—including the proprietary “Revenue Dip Probability Score” calculation—may be copied, reverse-engineered, scraped, or used to train competing models. Violations will incur statutory damages under the U.S. Copyright Act, plus a multiplier equal to the number of unauthorized derivative reports produced.
- User-Generated Reports. You may export and share reports you create, provided that (a) the Core Trio methodology and its underlying coefficients remain obfuscated, and (b) you attribute Business Analystic as the source of the predictive analytics using the phrase “Powered by Business Analystic’s n=3 metric model” with a hyperlink to our Contact Us page.
- Data Accuracy and Limitations. Our models are trained on historical datasets with a confidence interval of ±2.3% for revenue dip prediction. We do not guarantee that the three metrics will predict dips in every industry vertical; standard error may increase for sectors with less than 500 data points. You agree not to hold Business Analystic liable for decisions based on outputs with a p-value above 0.10.
- Termination. We reserve the right to terminate accounts that attempt to extract the Core Trio weights via brute-force API calls or that distribute our intellectual property outside your organization. Upon termination, you must delete all downloaded reports containing our proprietary metrics within 48 hours.
- Dispute Resolution. Any claim arising from these terms shall be resolved through binding arbitration in the jurisdiction where Business Analystic is established (United States). The prevailing party may recover reasonable attorney fees plus a multiplier of 1.5 for willful infringement.
By continuing to use the platform, you acknowledge that the predictive value of our three-metric model—validated against a 2020–2024 panel of 1,200 operations teams—is a trade secret. Unauthorized extraction or replication of the algorithm that identifies which three metrics are most correlated with next quarter’s revenue dip (R² = 0.87) will be pursued to the fullest extent of intellectual property law. This Terms of Service document itself is copyrighted by Business Analystic.
